Overview

Copyright registration provides legal recognition and protection for original creative works. Whether you are an author, musician, software developer, filmmaker, or artist, copyright registration strengthens your legal rights and provides documented proof of ownership.

At Startup Dost, we simplify the copyright registration process, handling everything from application preparation to filing with the Copyright Office, Government of India under the Copyright Act, 1957.

What is Copyright Registration?

Copyright is a legal right granted to the creator of an original work, giving them exclusive rights to reproduce, distribute, perform, display, or license their work. Registration formally records your work with the Copyright Office under the Department for Promotion of Industry and Internal Trade (DPIIT).

Types of works that can be registered:

  • Literary Works: Books, articles, blogs, computer programs (software), and databases.
  • Musical Works: Compositions, melodies, and musical arrangements.
  • Artistic Works: Paintings, sculptures, photographs, logos, and architectural designs.
  • Dramatic Works: Scripts, screenplays, choreographic works, and stage plays.
  • Cinematographic Films: Movies, documentaries, short films, and video content.
  • Sound Recordings: Recorded audio content, podcasts, and music albums.

Why is Copyright Registration Important?

  • Legal Evidence: Registration certificate serves as prima facie evidence of ownership in court.
  • Deterrence: Registered copyrights deter potential infringers.
  • Enforcement: Makes it easier to pursue legal action against infringement.
  • Licensing and Monetisation: Registered copyrights can be licensed to third parties.
  • International Protection: India is a signatory to the Berne Convention, recognised in 170+ member countries.
  • Asset Value: Adds value to your business during fundraising or acquisition discussions.

Who Needs Copyright Registration?

  • Authors and Writers publishing books, articles, or research papers.
  • Software Developers creating applications, websites, or digital products.
  • Musicians and Composers producing original music.
  • Photographers and Artists creating visual art and designs.
  • Filmmakers and Content Creators producing videos and digital content.
  • Businesses with proprietary content, marketing materials, or brand assets.
  • Startups building technology products with original code.

Documents Required for Copyright Registration

  • Copies of the work to be registered (manuscript, source code, design files, audio, etc.)
  • Name, address, and nationality of the applicant (author/owner)
  • PAN card and Aadhaar card of the applicant
  • NOC from the author, if the applicant is not the author
  • Power of Attorney in favour of the representative (if filing through an agent)
  • Details of the year and country of first publication
  • For software: source code printout (first 25 pages and last 25 pages)

Copyright Registration Process

Step 1: Application Preparation

We prepare the copyright application along with all required documents.

Step 2: Filing the Application

Filed online with the Copyright Office along with the prescribed government fee.

Step 3: Mandatory Waiting Period

After filing, there is a mandatory waiting period of 30 days during which objections can be raised.

Step 4: Examination by Copyright Office

If no objection is received, the Copyright Examiner reviews the application and may request additional information.

Step 5: Discrepancy Letter (if applicable)

If issues are found, a discrepancy letter is issued and must be responded to within the specified time.

Step 6: Registration and Diary Entry

Once approved, the work is entered in the Register of Copyrights and a Registration Certificate is issued.
